1. Acceptance of Terms

By accessing or using the website at missionbendasphaltpaving.com, submitting a contact form, requesting an estimate, or entering into a service agreement with Mission Bend Asphalt Paving("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.

These Terms apply to all visitors, customers, and others who interact with our website or engage our services. We reserve the right to update these Terms at any time. Changes take effect when posted on this page with a revised effective date.

2. Description of Services

Mission Bend Asphalt Paving provides asphalt paving, sealcoating, crack sealing, pothole repair, parking lot striping, concrete curbing, drainage solutions, grading and excavation, and related exterior paving services to residential and commercial customers in the Mission Bend, TX area and surrounding communities.

All services are subject to a written scope of work agreed upon by both parties prior to commencement. We reserve the right to decline any project at our discretion.

3. Estimates and Pricing

All estimates provided by Mission Bend Asphalt Paving are based on a site assessment and the information available at the time of the estimate. Written estimates are valid for 30 days from the date issued unless otherwise stated.

• Estimates are not guaranteed prices. Final costs may vary if conditions discovered during the work differ materially from what was visible at the time of the estimate - for example, hidden base failures, subsurface drainage issues, or additional materials required.
• Any change in project scope, additional work requested by the customer, or unforeseen site conditions will be communicated in writing before additional work proceeds.
• Asphalt material costs fluctuate with petroleum prices. We reserve the right to adjust pricing if material costs change significantly between the time of the estimate and the scheduled work date.
• Verbal estimates are not binding. Only written, signed agreements constitute an acceptance of a project.

4. Scheduling and Cancellation

Project scheduling is subject to crew availability, weather conditions, and material supply. We will provide reasonable advance notice of your scheduled start date.

• We reserve the right to postpone work due to weather conditions that would negatively affect the quality of the finished surface, including rain, extreme heat, or other adverse conditions.
• Customers who wish to cancel a confirmed project must provide at least 48 hours written notice. Cancellations made after work has begun may be subject to charges for labor, materials, and mobilization costs already incurred.
• We are not liable for delays caused by weather, supply chain disruptions, permitting delays, or other factors outside our reasonable control.

5. Payment Terms

Payment terms are specified in the written estimate or service agreement for each project. General terms include:

• A deposit may be required before work begins. The deposit amount, if any, will be stated in the written agreement.
• Final payment is due upon completion of the project unless otherwise agreed in writing.
• Accepted payment methods are stated in the written estimate. We do not accept payment under terms not agreed to in writing.
• Overdue balances may be subject to late fees as permitted under Texas law. We reserve all legal remedies for collection of unpaid balances, including filing a mechanic's lien where applicable.
• Full payment upfront is not required and should not be demanded by a legitimate contractor. If any representative of ours requests full payment before work begins, please contact us directly to verify.

6. Customer Responsibilities

To enable us to complete work safely and correctly, customers are responsible for:

• Clearing the work area of vehicles, equipment, furniture, and personal property before the scheduled start time.
• Identifying and marking the location of irrigation heads, utility covers, drainage grates, and other features that may be affected by paving work.
• Obtaining any required HOA pre-approval or permits for exterior work on their property.
• Keeping persons, pets, and vehicles off freshly paved or sealed surfaces for the curing period specified by our crew.

We are not responsible for damage to unmarked underground utilities, irrigation lines, or other features that were not disclosed or visible at the time of the estimate.

7. Warranty and Workmanship

We stand behind the quality of our work. Specific warranty terms, if any, will be stated in the written service agreement for each project.

• Warranty coverage applies to defects in workmanship. It does not cover damage caused by improper use, customer negligence, normal wear and tear, acts of nature, soil movement, or conditions that were not disclosed at the time of the estimate.
• Asphalt is a flexible material subject to natural weathering. Surface cracking, oxidation, and minor surface variations that develop over time are not covered under workmanship warranties.
• Any warranty claim must be reported to us in writing within the warranty period specified in your service agreement.

8. Warranty Disclaimers

Except as expressly stated in a written service agreement, all services are provided on an "as is" and "as available" basis. We disclaim all implied warranties to the fullest extent permitted by law, including any implied warranty of merchantability or fitness for a particular purpose. Our website content is provided for general informational purposes only and does not constitute a guarantee of specific results.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Mission Bend Asphalt Paving and its owners, employees, and contractors shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of our website or the provision of services, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of a specific project shall not exceed the amount paid by the customer for that project. This limitation does not apply to claims arising from our gross negligence or willful misconduct.

10. Dispute Resolution

We prefer to resolve any disputes directly and informally. If you have a concern about our work or billing, please contact us first at info@missionbendasphaltpaving.com and we will make a good-faith effort to address it promptly.

If an informal resolution is not reached, both parties agree to attempt mediation before pursuing other legal remedies. Any legal proceedings shall be brought exclusively in the courts of Texas, and the parties submit to the personal jurisdiction of those courts.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in courts located in Texas.

12. Website Use

The content on missionbendasphaltpaving.com is for general informational purposes only. You may not copy, reproduce, distribute, or modify content from this website without our written permission. You agree not to use our website for any unlawful purpose or in any way that could damage, disable, or impair the site or interfere with other users.

13. Changes to These Terms
